Affiliate Terms and Conditions

This is a legal agreement between you (the affiliate) and best sock (the merchant). By submitting the online application, you agree that you have read and understood the terms and conditions of this agreement and agree to be legally responsible for maintaining each term and condition.

This Website guarantees the protection and confidentiality of the personal data provided to us in accordance with the provisions of the General Regulation on the Protection of Personal Data (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016. , in the Organic Law 3/2018, on the Protection of Personal Data and guarantee of digital rights, as well as in the Law on Information Society Services and Electronic Commerce 34/2002 of July 11 (LSSI-CE).

2.- Affiliate program commissions

When an affiliate is accepted into our affiliate program, they will choose a model of socks that they believe is most appropriate for their audience, on which they will carry out promotional campaigns for the socks supplied by the best sock and only these.

It is prohibited to associate Darn Tough socks with any other brand unless express consent is given by the best sock.

This pair of socks will be free and will be a gift that will serve to promote the socks supplied by the best sock.

When an affiliate has generated 1 to 10 orders in a year, they will have a 5% commission. When the affiliate has generated 11 to 30 orders in a year, they will have a 7% commission. When an affiliate has generated more than 30 orders in a year, they will have a 10% commission.

In the event that there is a discount, the commission will be based on the discount applied.

Own purchases do not generate commission, but they have the discount on the commission.

These commissions will be saved for up to a maximum of one year. If after that year the minimum amount is not reached, the commissions will be definitively eliminated without the affiliate being able to claim their payment.

Additionally, if in a year there is no activity in commissions and sales, the account may be closed or suspended.

Affiliates will have exclusive access to offers from other brands.

Affiliate tracking cookie:

The assignment of commissions is made in relation to the tracking cookie that is installed in the browser when a user clicks on your affiliate link and is saved (unless the user deletes cookies in their browser) for 90 days ; But keep in mind that if after clicking your link the customer clicks on another affiliate link, the latter's cookie will be taken into account. The last affiliate link that the customer clicked on before making the purchase is always taken into account to assign the commission, since it will be your cookie that is saved in your browser.

If the referral purchases after 90 days that the cookie is saved in their browser, the system will not be able to know that it comes from that affiliate. It is recommended that you access the affiliate url before purchasing. As the cookie is saved in the browser, if the aforementioned purchase is made from another browser (either on the same computer or device; or on a different one) it will not have the cookie in that new browser. You must contract from the same browser or access the affiliate url there before purchasing.

3.- Payment

Commissions are paid once the amount of commissions amounts to more than €50. Payment will be made between the 10th and 15th of the month following the month calculated in order to account for possible returns made.

All commissions are paid in euros and are made by bank transfer. In the event that the affiliate wants payment to be made by another means, the proposal will be studied. The decision will always be made by those responsible for the website www.elmejorcalcetín.es

4.- Clients

Our clients are not and do not become, by virtue of their participation in the Affiliate Program, your clients. Consequently, as between you and us, all prices, conditions of sale, rules, policies and operating procedures relating to customer orders, customer service and sales of products collected on the website www.elmejorcalcetin.es will also apply to said clients, and may be modified at any time. You may not deal directly with, address or manage any contact received from any of our clients; and, if any of our clients contact you about a matter related to interaction with this website, you must indicate that clients are obliged to follow the contact instructions listed on www.elmejorcalcetin.es to discuss issues related to customer service. .

5.- Acceptance or denial of the registration request

Acceptance of the registration request is completed automatically by clicking on the 'Yes, I accept the contract and activate my affiliate account' button described above. However, the best sock reserves the right to deny or cancel registration in the program to any applicant or member who does not meet the necessary requirements described in the program conditions. It also reserves the right to deny or cancel registration in cases where it considers that the profile, conduct or supports of the applicant are inappropriate to be part of the affiliate program.

6.- Exemption from Liability

The affiliate program, the site www.elmejorcalcetín.es, the products and services offered on the site www.elmejorcalcetín.es, any of the special links, link formats, content, any application for product advertising, food data, advertising content, our domain names, trademarks and logos and those of our related entities (including the brands of www.elmejorcalcetín.es) and all technology, software, functions, materials, data, images, text and other intellectual and industrial property rights, information and content provided or used by us or by our related entities or within the framework of the affiliate program. We reserve the right to suspend any service offering, or to change the nature, features, functions, scope or operation of any service offering, at any time and as many times as we deem appropriate. We are not responsible when interruptions, inaccuracies, errors occur. Neither we nor any of our affiliated entities or licensors will be responsible or liable for (a) any errors, inaccuracies, viruses, malware or service interruptions, including power outages or system failures, or for (b) the unauthorized access to or alteration, deletion, destruction, damage or loss of your site or any of its data, images, text or other information or content. The advice or information that you may obtain from us or from any other person or entity or through the offers will not create or imply the creation of any type of guarantee that is not expressly included in this agreement. furthermore, neither we nor any of our related entities or licensors will be or be responsible for any type of compensation, refund or compensation for damages arising from (x) the loss of profits or potential revenues, anticipated sales, goodwill or other advantages or benefits; (y) the investments, expenses or commitments that you assume or have assumed as a result of your participation in the affiliate program; or (z) the termination or suspension of your participation in the affiliate program. Nothing in this clause is intended to exclude or limit or serve to exclude or limit any warranties, liabilities or representations that cannot be excluded or limited under applicable law.

7.- Modifications

We reserve the right to modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice, a revised Agreement or Program Policy on the Affiliate Site, or by sending you a notification of such modification by email to the primary email address currently linked to your Affiliate account. The effective date of said change, except in the case of increases in the Standard Commission Income of the Program and Commission Income for Special Programs, will be the date indicated in the notification, which in no case will be earlier than the date within seven (7) calendar days from the date on which the notification was made. Your continuity in the affiliate program once the effective date of the corresponding modification has passed will constitute your acceptance of the modifications made. If any modification is unacceptable to you, your only recourse will be to terminate this agreement by explicitly notifying hola@elmejorcalcetin.es
